At Get8Net, we prioritize the privacy and trust of our customers while supporting the lawful exchange of information. This document outlines the procedures for government agencies, law enforcement authorities, and individuals involved in civil litigation when requesting customer data. Please note that these guidelines serve as informational reference and do not constitute a commitment from Get8Net to provide information. We reserve the right to respond or object to any Data Request in accordance with applicable law.

These guidelines do not apply to customers' requests for their own data. Customers should contact our customer support at info@get8net.com for such inquiries.

Get8Net's Commitment to Privacy

We are dedicated to safeguarding our customers' privacy and trust. In line with this commitment:

  1. We will, to the extent permitted by law, notify our customers or partners about any Data Request related to their data, as explained further in Section VIII.
  2. Get8Net will carefully review the legality of each Data Request and challenge it if inconsistencies or inaccuracies are identified.
  3. We will provide the narrowest set of permissible information when responding to a Data Request based on a reasonable interpretation.
  4. Any improperly served or incomplete requests will be rejected.
  5. Get8Net retains the right to object to Data Requests for any reason.

In emergency cases where disclosing customer data is crucial to preventing imminent harm, we may make exceptions to these commitments. In such cases, we will notify the customer, as legally permitted.

Types of Requests

Get8Net considers the following types of requests, each requiring formal legal process:

Data Request

A Data Request seeks information related to an official criminal or administrative investigation, proceeding, or civil legal action. This includes subpoenas, court orders, search warrants, and civil investigative demands. Data Requests can come from government agencies, law enforcement, or private parties.

Preservation Request

A Preservation Request asks Get8Net to safeguard customer account data during an official investigation or proceeding. Preservation Requests should include specific details, as outlined in Section V. We generally preserve data for 90 days, pending formal legal process.

Emergency Request

Emergency requests for customer data require an Emergency Data Request Form or a valid court order. These requests are appropriate only when there is a risk of serious harm or death. Absent a court order, we respond to such requests when we believe imminent harm is possible.

Expedited Requests

Upon request, and subject to the fees specified in Section XI, we may expedite Data Requests on a case-by-case basis. However, we do not guarantee expedited handling.

Submitting a Data Request

Service of Process by Government Agencies or Law Enforcement

Government Data Requests should be submitted by providing all necessary information to info@get8net.com. Complete requests are considered for processing.

We accept service of subpoenas, warrants, court orders, and civil investigative demands exclusively at info@get8net.com, along with a copy sent to our registered agent for service of process, as permitted by applicable laws. Please note that this acceptance of service is voluntary and may change without notice.

We do not accept fax or email service for legal process requiring the oral testimony or personal appearance of an Get8Net representative. Personal service on our registered agent is required for such requests.

Service of Process in Civil Matters

All civil service of process must adhere to California state or federal court regulations, following the laws of the State of California.

Information to Include in Data Requests

All Data Requests must contain the following information:

  • Telephone number or user identification number (UID).
  • A specific date or a narrowly tailored date range (generally up to 2 months).

We will not respond to Data Requests that could infringe on the privacy rights of unrelated customers. We encourage government requestors to include a protective order when necessary.

To verify the authenticity of a Government Data Request, it must include:

  • Requesting agency's name.
  • Requesting agent's name.
  • Requesting agent's badge/identification number.
  • Requesting agent's employer-issued email address.
  • Requesting agent's telephone number.
  • Requesting agent's mailing address.

Please provide a copy of the warrant, court order, or subpoena, including any non-disclosure order that may restrict us from notifying customers.

Civil Data Requests

Civil Data Requests must include:

1.Requesting party's name.

2.Counsel name and applicable State Bar Number.

3.Telephone number.

4.Email address.

5.Mailing address.

6.Requested response date.

7.A copy of the subpoena to which the request is made.

Private litigants are encouraged to seek data directly from the Get8Net customer or end user, who can use account tools to access their relevant data. Applicable law limits our ability to produce certain data without a warrant or customer consent.

Time for Response

We generally respond to Data Requests in the order received, with priority given to emergency, law enforcement, and expedited requests. Most requests receive a response within thirty (30) days, although response times vary based on request complexity.

Format of Response

We typically provide responsive information via email in a compressed, password-protected file. For larger data volumes, we may offer the file for download through a secure Get8Net Box account or FTP server.

Information Available in Response to Data Requests

  • Government Requests: Get8Net may provide Account Information, Call/Fax/SMS Log Data, or Content of Communications in response to valid Government Requests. We only provide the Content of Communications with customer consent or when compelled by law.
  • Civil Requests: In response to properly served and narrowly tailored Civil Requests, we generally provide readily available Account Information or Call/Fax/SMS Logs. Production of Call/Fax/SMS Logs may be subject to objection.
